SHOCK RADIO HAS ITS DAY IN COURT

CBC

The top-rated CHOI-FM will have its case heard before the Federal Court of Appeal.

The shock radio station in Quebec City was ordered removed from the airwaves in 2004, by the Canada Radio-television and Telecommunications Commission.

The CRTC judged the Broadcasting Act was violated repeatedly by radio host Jeff Fillion.

CHOI-FM's parent company, Genex Communications, is reportedly preparing to argue that the CTRC didn't give proper notice that the station's licence would not be renewed.

It will also argue that the CRTC decision is unconstitutional, and that broadcasting is provincial jurisdiction.

The station was set to be pulled off the air on Aug. 31, 2004, but was given a reprieve while its appeal was heard.
